Terms of Service

1. Acceptance of Terms

By registering an account, purchasing a subscription, downloading our Add-in, or accessing our content, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must immediately cease use of the Platform. You represent you are of legal age to form a binding contract (at least 18 years old in most jurisdictions).

2. Definitions

• "Platform" refers to the BIMUsers.com website, web applications, servers, databases, and APIs.
• "Service(s)" refers to file hosting, community forums, AI generation tools, subscription plans, and software add-ins provided by us.
• "Add-in" refers to the BIMUsers plugin/extension developed for third-party software (e.g., Autodesk Revit).
• "User Content" refers to any BIM models (RVT, IFC, DWG, etc.), images, text, or parameters uploaded by users.

3. Accounts, Security, and Single Sign-On (SSO)

Account Creation: You must provide accurate and complete information. You are strictly prohibited from sharing your account credentials with third parties or team members (unless explicitly permitted under an Enterprise plan).

Google & Third-Party Login: We may offer the ability to register and log in using third-party services (e.g., Google OAuth). By using these services, you grant us permission to access specific data (like your email address) as permitted by the third party. We are not responsible for the uptime, security breaches, or policies of Google or other identity providers.

Security: You are responsible for all activity under your account. You must notify us immediately of any unauthorized access.

4. Subscriptions, Payments, and Refunds

We offer both Free and Premium/Constant subscription tiers.

• Billing Cycle: Premium plans are billed in advance on a recurring basis (monthly or annually). Your subscription will automatically renew unless canceled prior to the renewal date.
• Price Changes: We reserve the right to modify our pricing at any time. We will provide at least 30 days' notice before changes affect active subscribers.
• No Refunds on Digital Goods: Due to the nature of digital downloads, CAD models, and instant platform access, ALL SALES ARE FINAL. We do not offer prorated refunds for canceled subscriptions or downloaded files, except where strictly mandated by law.
• Downgrades: If you downgrade to a Free plan, you may lose access to certain files, features, or storage limits. We are not liable for any data loss resulting from a downgrade.

6. Artificial Intelligence (AI) Features

Our Platform may utilize AI, machine learning, or automated generation tools (e.g., AI chat assistants, automated parameter generation, or design suggestions).

• No Guarantee of Accuracy: AI-generated outputs are probabilistic and may contain errors, "hallucinations," or inaccurate engineering data. You must independently verify all AI outputs.
• Data Usage: By interacting with our AI features, you agree that your inputs (prompts, non-confidential search queries) may be used to improve and train our services. Do not input confidential client data into AI prompts.

8. User-Generated Content and File Sharing

License to BIMUsers: By uploading models, families, or posts ("User Content"), you retain your copyright, but you grant BIMUsers.com a worldwide, perpetual, non-exclusive, royalty-free license to host, parse, display, modify (for technical formatting), and distribute this content to other users.

Your Warranties: You warrant that you have the legal right to upload the content. You agree NOT to upload files containing proprietary company templates, sensitive national security infrastructure plans, or NDA-protected client designs without explicit authorization.

9. Prohibited Conduct and Anti-Scraping

To protect our infrastructure and community, the following actions are strictly forbidden:

• Data Scraping: Using bots, crawlers, spiders, or automated scripts to mass-download files, scrape user data, or copy our database.
• Reselling: Downloading files from BIMUsers.com and repackaging them for sale on competing platforms.
• Malware: Intentionally uploading files infected with viruses, ransomware, or malicious macros.
• Abuse: Harassing other users in community forums or spamming promotional links.

10. Intellectual Property Rights of the Platform

Excluding User Content, all materials on the Platform, including the BIMUsers logo, website design, Add-in source code, proprietary algorithms, and text, are owned by BIMUsers.com and are protected by international copyright, trademark, and intellectual property laws. You may not copy or reverse-engineer our Platform.

11. Copyright Infringement & DMCA Policy

We respect intellectual property. If you believe your copyrighted work (e.g., proprietary manufacturer models) has been uploaded without authorization, submit a DMCA Takedown Notice to copyright@bimusers.com including:

• Your physical/electronic signature.
• Identification of the copyrighted work.
• The exact URL of the infringing material.
• Your contact details.
• A statement, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

12. Third-Party Integrations & Links

The Platform may contain links to third-party websites or integrate with third-party software (e.g., Autodesk, payment gateways like Stripe). We do not endorse and are not responsible for the content, security, or practices of these third parties. Your interactions with third-party services are solely between you and the third party.

13. API Access & Usage

If we grant you access to the BIMUsers API, such access is provided at our discretion. We may impose rate limits, revoke access, or deprecate endpoints at any time without notice. You agree not to use the API to replicate our core Service or overload our servers.

14. Data Privacy & Cookie Policy

Your privacy is important to us. Our collection and use of personal information, including Google account data, payment data, and usage metrics (via cookies), are governed by our Privacy Policy. By using the Platform, you consent to our data practices.

15. Termination of Accounts

We reserve the right to suspend or permanently terminate your account, IP address access, and subscription at our sole discretion, without notice or liability, if we determine you have violated these Terms, engaged in fraudulent activity, or posed a security risk to the Platform. Upon termination, your right to use the Platform ceases immediately.

16. Disclaimer of Warranties

THE PLATFORM, ADD-INS, AI FEATURES, AND ALL FILES ARE PROVIDED "AS IS" AND "AS AVAILABLE". BIMUSERS.COM EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BIMUSERS.COM, ITS FOUNDERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM, ADD-INS, OR DOWNLOADED FILES. IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

18. Indemnification

You agree to defend, indemnify, and hold harmless BIMUsers.com from any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your User Content, or your use of files downloaded from the Platform in professional projects.

19. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, server outages, internet backbone failures, cyber-attacks, or governmental actions.
